This Privacy Policy sets out how STUNNER ALERT PTY LTD ABN 88 701 443 129 ('we', 'us' or 'our') collects, holds, uses and discloses personal information in connection with our website at www.stunneralert.com.au, the STUNNER ALERT online marketplace and booking platform (Platform), any account created through the Platform (Account), and the Platform Services we provide to Customers and independent Professionals.

The Platform enables Customers to browse and make Bookings for Professional Services offered by independent Professionals and enables Professionals to create profiles and listings, manage Bookings, communicate with Customers and receive payments facilitated through the Platform. STUNNER ALERT provides the Platform Services and does not provide the underlying Professional Services.

We take our privacy obligations seriously and are committed to handling personal information in a transparent and responsible manner.

This Privacy Policy explains the types of personal information we may collect, how we collect and use that information, the circumstances in which we may disclose it, how we protect and retain it, and how you may contact us to access or correct your personal information or make a privacy complaint.

We collect, hold, use and disclose personal information as described in this Privacy Policy and in accordance with applicable law. This Privacy Policy does not constitute a request for blanket consent to current or future privacy practices and does not waive any statutory privacy rights.

We may update this Privacy Policy from time to time to reflect changes to the Website, Platform, our practices, third-party service providers or applicable law by publishing an updated version on the Website or otherwise making it reasonably available through the Platform.

Where reasonably practicable, we will give reasonable notice of a material change that may adversely affect individuals. An update to this Privacy Policy does not retrospectively authorise the handling of personal information in a manner that was unlawful when the relevant handling occurred.

The types of personal information we may collect depend on how you interact with us, the Website and the Platform and whether you use the Platform as a Customer or Professional, and may include: your name, email address, telephone number and other contact details; Account information, login information and other information associated with your use of the Platform; identity information, government-issued photographic identification, and identity-verification photographs or selfies (including a photograph of a person holding identification), where requested for identity or eligibility verification; if you are a Professional, your ABN and relevant business details, GST registration status where collected, Professional Services and pricing, qualifications, licences, registrations, approvals, hygiene certificates or similar credentials, experience, and public liability insurance information and Certificates of Currency, in each case where requested for onboarding, verification, profile, payment, tax or regulatory purposes; if you are a Professional, profile information, business websites, professional social media handles or accounts, service descriptions, availability, service areas, portfolio photographs and other Professional Content, where requested or submitted for onboarding, verification, profile or Platform purposes; Booking information, including the Professional Services requested or offered, booking dates and times, booking history, cancellations, rescheduling and other information relating to a Booking; addresses, service locations and other location information provided or generated in connection with a Booking or use of the Platform; communications between Customers and Professionals through the Platform and communications, enquiries, complaints, feedback or other information you provide when contacting us; information relating to safety incidents, complaints, disputes or other matters reported through or in connection with the Platform; transaction and payment-related information received or held by us, including Customer payment and Professional payout amounts and status, Marketplace Facilitation Fee deductions and associated GST, refunds, chargebacks, reversals, payment disputes, payment adjustments and other information reasonably required to facilitate, administer or reconcile payments; information about how you access and use the Website and Platform, including searches, page or feature views, clicks and other interactions; device information, device type, IP address, browser information, usage information and standard web log information; information collected through cookies, Firebase Analytics and similar technologies as described in our Cookies Policy; marketing preferences and information relating to promotional communications, where applicable; and any other personal information you choose to provide to us or that we reasonably require to operate the Website or Platform, provide the Platform Services, administer a Booking or comply with applicable law.

Payments relating to Bookings are facilitated through Stripe Connect, including Customer payments, Professional connected accounts and payouts. Stripe may directly collect and process card, bank account, identity, verification and compliance information required to provide its payment services. We may receive and hold transaction and payment-related information from Stripe where reasonably necessary to facilitate, administer, reconcile or respond to Customer payments, Professional payouts, Marketplace Facilitation Fee deductions and associated GST, refunds, chargebacks, reversals, payment disputes and payment adjustments, but we do not state that we store complete card details processed directly by Stripe.

The personal information we collect about a Professional may differ from the information we collect about a Customer because Professionals may be required to provide information relevant to their eligibility, identity, business and tax status, Professional Services, qualifications, licences, registrations, approvals and insurance. Where we conduct identity, qualification or eligibility verification concerning a delegate, assistant, subcontractor or other person engaged by a Professional, we may also collect identity information, identification documents, qualifications, licences, registrations, hygiene certificates, insurance information and other information reasonably required to assess that person's eligibility; STUNNER ALERT does not employ or supervise those persons merely because it conducts that verification.

3. If You Do Not Provide Personal Information

You may choose not to provide personal information to us, but in some circumstances this may affect our ability to provide particular features of the Website, Platform or Platform Services to you.

Where personal information is reasonably required to create or administer an Account, verify identity or Professional eligibility, make or manage a Booking, facilitate a payment, communicate information required for a Booking or comply with applicable law, we may be unable to provide the relevant functionality or Platform Service if that information is not provided.

Professionals may also be unable to create or maintain a Professional profile, remain eligible to use the Platform or receive Bookings if they do not provide information reasonably required to establish or maintain their eligibility, including identification, qualification, licence or insurance information where applicable.

We will not require personal information that is not reasonably necessary for the relevant purpose merely as a condition of accessing functionality for which that information is not required.

4. Personal Information of Minors

The Platform may be used in connection with Professional Services involving or attended by minors.

Where personal information about a minor is provided to us in connection with a Booking or Professional Service, the person providing that information must be authorised to provide it and must obtain any consent required by applicable law.

We do not require a minor to create or maintain a Professional Account, and Professionals must satisfy the eligibility requirements applying to Professional Accounts under the applicable Professional terms and conditions.

If we become aware that personal information relating to a minor has been collected or provided in circumstances where we are not permitted or do not reasonably require that information, we will take reasonable steps to delete, de-identify or otherwise appropriately deal with that information in accordance with applicable law.

5. How We Collect Personal Information

We may collect personal information directly from you, automatically when you use the Website or Platform, from other users of the Platform, or from third parties where reasonably necessary to operate the Platform, provide the Platform Services or administer a Booking.

We may collect personal information when you: create or use an Account; create, maintain or update a Customer or Professional profile; if you are a Professional, provide business or tax details, identification or verification photographs, qualifications, licences, registrations, approvals, hygiene credentials, insurance information, Professional Service and pricing information, availability, service areas, business websites, professional social media accounts, portfolio photographs or other Professional Content relevant to your onboarding, eligibility, profile or listings; browse, request, make, accept, manage, reschedule or cancel a Booking; provide or update a service location, address or other information required in connection with a Booking; communicate with a Customer or Professional through the Platform; make or receive a payment facilitated through the Platform; contact or communicate with us through the Website, Platform, email or another communication channel; submit an enquiry, complaint, safety report, payment dispute, feedback or other request; use or interact with the Website or Platform; or otherwise provide personal information to us.

We may automatically collect information about your use of the Website and Platform through cookies, analytics technologies and similar technologies. This may include information about your device, IP address, browser, pages or features viewed, searches, clicks, interactions and other usage information.

We may use cookies and similar technologies to support Website and Platform functionality, authentication, Account and session functionality, security, analytics and other purposes described in our Cookies Policy.

We may receive personal information about you from another user where reasonably necessary in connection with a Booking, communication, complaint, safety incident or other interaction through the Platform. For example, a Customer may provide information relevant to a Booking involving a Professional, and a Professional may provide information relevant to a Customer or service location in connection with the performance or administration of Professional Services.

We may also receive personal information from third-party service providers involved in operating the Platform or providing the Platform Services, including Stripe and other payment, hosting, technology, communications or analytics providers, to the extent reasonably necessary for the relevant purpose.

6. Cookies, Analytics and Similar Technologies

We use cookies, analytics technologies and similar technologies in connection with the Website and Platform.

We use Firebase Analytics to collect information about how users access and interact with the Website and Platform, including clicks and other usage activity, to help us understand usage patterns, identify technical or usability issues and improve the Website, Platform and Platform Services.

Cookies and similar technologies may also be used to support authentication, login and session functionality, security and other functionality of the Website and Platform.

We do not currently use cookies or analytics information to display personalised advertising.

If our use of analytics, advertising or similar technologies materially changes, we will update our Cookies Policy and this Privacy Policy where appropriate and will provide any notice, choice or consent required by applicable law.

7. Use of Your Personal Information

We may collect, hold and use personal information for purposes including: creating, maintaining and administering your Account; identifying and authenticating users and maintaining Account and Platform security; if you are a Professional, assessing and administering your eligibility to use the Platform, including reviewing identification and identity-verification photographs, qualifications, licences, registrations, approvals, hygiene credentials, insurance information and other information reasonably required for onboarding or verification, and conducting equivalent verification of delegates, assistants, subcontractors or other persons you engage where required for Platform eligibility; creating, maintaining and displaying Professional profiles, listings, Professional Service information, availability, service areas, photographs and portfolio materials; enabling Customers to browse Professional profiles and Professional Services and make Booking decisions; facilitating, administering and managing Bookings between Customers and Professionals; providing Customers and Professionals with information reasonably necessary to arrange, manage or perform a Booking; facilitating communications between Customers and Professionals through the Platform; facilitating, administering and reconciling Customer payments, Professional connected accounts and payouts, Marketplace Facilitation Fee deductions and associated GST, refunds, chargebacks, reversals, payment disputes, payment adjustments, and verification or compliance processes through Stripe or another applicable Payment Provider; operating, maintaining, securing, administering and improving the Website, Platform and Platform Services; analysing how users access and interact with the Website and Platform, including through cookies, analytics technologies and similar technologies; communicating with you about your Account, Bookings, payments, enquiries, Platform updates, security matters and other administrative matters; responding to enquiries, handling complaints, moderating reviews, resolving disputes and investigating safety incidents and other reports; investigating and managing reasonably suspected fraud, chargebacks, Platform misuse, intentional circumvention, security incidents, safety issues, unlawful activity or breaches of the Customer Terms or Professional Terms, and taking proportionate action including Account suspension or termination where permitted by those terms or law; enforcing our agreements and protecting our legal rights and the rights and safety of Customers, Professionals and other persons; sending marketing or promotional communications where permitted by applicable law and subject to any consent or unsubscribe requirements that apply; collecting, using, retaining and disclosing Professional information reasonably necessary for tax administration, record keeping, issuing or facilitating payment or tax documentation, ABN or GST administration, and reporting obligations to the Australian Taxation Office or other authorities, which may include a Professional's name, business details, ABN, GST registration status, Booking information, transaction and payout information, Marketplace Facilitation Fees and other payment information reasonably required, and, if applicable under the Professional Terms, information used to facilitate an RCTI; and otherwise carrying out a purpose that is reasonably necessary for the operation of the Platform or provision of the Platform Services and is permitted by applicable law.

We may disclose personal information to our Personnel, contractors, professional advisers, Customers, Professionals and third-party service providers where reasonably necessary for these purposes, including providers involved in hosting, database infrastructure, payment processing, communications, analytics and other technology used to operate the Website and Platform.

Where we disclose Customer personal information to a Professional, we will limit that disclosure to information reasonably necessary to facilitate, administer or perform the relevant Booking, or as otherwise permitted or required by law; this may include the Customer's name, contact information, service location and access information, Booking information, relevant communications, complaints, reviews, safety incident information, payment-related information and other information reasonably necessary for the Booking.

8. Direct Marketing

Where permitted by applicable law, we may use your contact details to send you information about STUNNER ALERT, the Platform, Platform Services, promotions, offers or other marketing communications that we reasonably consider may be relevant to you.

We may send direct marketing communications by email, SMS or another electronic communication method where we have any consent required by applicable law or are otherwise permitted to do so.

You may opt out of receiving direct marketing communications at any time by using the unsubscribe or opt-out mechanism included in the relevant communication, where available, or by contacting us using the details set out in the Contact Us section of this Privacy Policy.

We will take reasonable steps to action an opt-out request within the timeframe required by applicable law.

Opting out of direct marketing communications does not prevent us from sending communications that are reasonably necessary to administer your Account, manage a Booking or payment, provide the Platform Services, respond to an enquiry or complaint, provide security or service information or otherwise communicate with you where permitted or required by law.

We do not currently use personal information collected through cookies or analytics technologies to display personalised advertising.

9. Disclosure of Personal Information

We may disclose personal information where reasonably necessary to operate and administer the Website and Platform, provide the Platform Services, facilitate Bookings and payments, or for another purpose described in this Privacy Policy.

We may disclose personal information to: our Personnel, contractors and professional advisers; Customers and Professionals to the extent reasonably necessary to facilitate, administer or perform a Booking or enable communications relating to Professional Services; hosting, cloud infrastructure, database and technology service providers, including Amazon Web Services and MongoDB; payment processors and payment service providers, including Stripe; analytics, communications and other technology providers used in connection with the Website or Platform; marketing and social media service providers where we use those services and have any consent or other legal basis required by applicable law; professional advisers, insurers, auditors and other service providers who assist us in operating our business; government bodies, regulators, courts, law enforcement agencies or other persons where disclosure is required or authorised by law; and other persons where you have authorised or requested the disclosure or where disclosure is otherwise permitted by applicable law.

Where a Customer makes or manages a Booking, we may disclose personal information to the relevant Professional only where reasonably necessary to facilitate, administer or perform the Booking or as otherwise permitted or required by law. This may include the Customer's name, contact information, service location and access information, Booking information, relevant communications, complaints, reviews, safety incident information, payment-related information and other information reasonably necessary for the Booking.

Where a Professional is listed on the Platform or participates in a Booking, we may disclose information about that Professional to Customers where reasonably necessary to operate the Platform or facilitate a Booking. This may include the Professional's name, profile photograph, Professional Service information, qualifications or credentials displayed through the Platform, portfolio materials, availability, service area and other information forming part of the Professional's profile or listing.

We may disclose photographs, portfolio materials or other Professional Content for the purposes described in this Privacy Policy and the applicable Professional terms, including displaying Professional profiles and, where appropriate permissions have been obtained, promoting the Platform through marketing or social media channels.

Stripe may directly collect, process and disclose payment method, bank account, identity, verification and compliance information in connection with Stripe Connect, Customer payments and Professional connected accounts and payouts. We may receive, hold, use and disclose transaction and payment-related information, including amounts and status, Marketplace Facilitation Fee deductions and associated GST, refunds, chargebacks, reversals, payment disputes and payment adjustments, where reasonably necessary to administer or reconcile a Booking or payment, meet tax or regulatory obligations, or protect users from fraud; information handled directly by Stripe is subject to Stripe's applicable privacy practices, and we do not state that STUNNER ALERT stores complete card details.

Where we use information for analytics, reporting or improvement purposes, we may aggregate or de-identify information where reasonably appropriate so that it is no longer reasonably capable of identifying an individual.

Any disclosure of personal information under this section is subject to applicable law and the purposes described in this Privacy Policy.

10. Overseas Disclosure

We intend to use Australian data centres where appropriate for information hosted or processed in connection with the Platform. However, we do not guarantee that all personal information will be stored, processed or accessed exclusively within Australia.

Some third-party service providers we use, including hosting, database, payment, analytics, communications, marketing and other technology providers, may store or process personal information, or permit it to be accessed, from locations outside Australia.

The countries in which those providers and their subprocessors operate may vary depending on the provider, service configuration and infrastructure used from time to time. We will not represent that personal information is disclosed to a particular overseas country unless that location has been confirmed.

Where we disclose personal information to an overseas recipient, we will take reasonable steps in relation to that disclosure where required by applicable privacy law.

We may update this Privacy Policy where reasonably practicable to reflect material changes to the locations in which overseas recipients of personal information are likely to be located.

11. Automated Processing

We may use automated systems and other technology in connection with the operation of the Website and Platform, including to support Account functionality, authentication, analytics, Booking administration, payment processing and other Platform functionality.

We use analytics technologies to process information about how users interact with the Website and Platform, including clicks and other usage activity, for the purposes described in this Privacy Policy and our Cookies Policy.

Where third-party providers use automated systems or technology in providing services to us, any personal information made available to those providers will be limited to what is reasonably necessary for the relevant purpose and handled subject to applicable law and the provider's applicable privacy practices.

We do not state that artificial intelligence is used to make decisions about Customers, Professionals or Bookings unless and until that functionality is implemented and this Privacy Policy is updated accordingly.

12. Security

We take reasonable steps to protect personal information we hold from misuse, interference, loss and unauthorised access, modification or disclosure.

We use administrative, technical and organisational measures that we consider appropriate having regard to the nature of the personal information we hold and the manner in which it is collected, stored, used and disclosed.

We may rely on third-party hosting, database, infrastructure and technology providers in operating the Website and Platform and storing or processing personal information, including Amazon Web Services and MongoDB.

We intend to use Australian data centres where appropriate, but we do not guarantee that all personal information will be stored or processed exclusively in Australia. Some third-party service providers and their subprocessors may store, process or access personal information from locations outside Australia as described in the Overseas Disclosure section of this Privacy Policy.

While we take reasonable steps to protect personal information, no method of electronic transmission, storage or processing is completely secure and we cannot guarantee the absolute security of personal information.

If we become aware of a privacy or data security incident affecting personal information, we will take reasonable steps to investigate, contain and respond to the incident and will make any notification required by applicable law.

13. Retention and Deletion

We retain personal information for as long as reasonably necessary for the purposes for which it was collected or another purpose permitted by law, including to create and administer Accounts, operate the Platform, provide the Platform Services, facilitate and administer Bookings and payments, maintain appropriate business, transaction and tax records, manage complaints and safety incidents, resolve disputes, investigate reasonably suspected fraud, chargebacks, Platform misuse or intentional circumvention, enforce the Customer Terms or Professional Terms, and comply with legal, tax and regulatory obligations.

The period for which we retain personal information may vary depending on: the type and sensitivity of the information; the purpose for which the information was collected, used or disclosed; whether the information relates to an Account, Professional profile, Booking, payment, complaint, safety incident or dispute; any applicable legal, accounting, insurance, operational or regulatory requirements; and whether continued retention is reasonably necessary to establish, exercise or defend a legal claim.

Where we no longer require personal information for a purpose for which we are permitted to use or disclose it, we will take reasonable steps to destroy or de-identify that information unless we are required or authorised by law to retain it.

Closing or deleting an Account does not necessarily result in the immediate deletion of all personal information associated with that Account. We may retain information where reasonably necessary for outstanding Bookings, payments, complaints, safety matters, fraud prevention, dispute resolution, legal claims, record-keeping or other purposes permitted or required by law.

Information held in backups, archives or systems maintained for security, continuity or technical purposes may remain for a period after information is removed from active systems and will be handled in accordance with our applicable retention and security practices.

De-identified or aggregated information that is no longer reasonably capable of identifying an individual may be retained and used for legitimate business purposes, including analytics, reporting, security and improving the Website, Platform and Platform Services.

14. Data Breaches

If we become aware of an actual or suspected data breach involving personal information, we will take reasonable steps to contain, investigate and assess the incident and reduce the risk of harm arising from it.
